President Willam Ruto has through the office of the Arttoney General appointed Makueni Governor Mutula Kilonzo Jnr to serve as a Commisiinner at Kenya Law Reform Commission (KLRC) for a six year non-renewable term effective April to this year.
This move is likely to draw legal battle as a section of members of civil society in Makueni push for Mutula’s resignation or impeachment over the controversial appointment by the President.
The law doesnot allow a sitting County Governor in Kenya to be appointed to a National Government Commission while holding office.
The Constitution strictly prohibits full-time State officers, such as Governors, from participating in any other gainful employment.
This is not only irregular and unlawful but also tantamount to conflict of interest as KLRC serves both national and county levels of government by providing; Law Review, Legislative Drafting, Technical Advisory, Constitutional Implementation and supporting devolution.
Mutula has for the longest time been seen as a mole in Wiper Party. A sectoin of Ukambani UDA leaders led by Kibwezi West MP Mwengi Mutuse have often described him as a man who will spend the day with the Kalonzo led opposition and dine with Ruto at night. He spents most of his weekends with his former Senate collegues Sakaja, Kindiki, Kang’ata and Murkomen who are in Ruto’s rulking Party over the weekend. The young aman who for years was once the face of the Party nolonger accompanies Kalonzo in political rallies outside Ukambani like before.
The son of Kilonzo is not new to controversy, he recently left tougues wagging when he openly told the President that he can consider working with him. “Ukijenga hii barabara na ulete maji, hio mambo itakuwa sawa” ~ he said during a tour in Makueni. He is also on record questioning the capacity of his Wiper Party Leader to fund his Presidential compaign “How will you become President if you can’t even afford 10 million shillings? “. He recently warned Kalonzo not to trust Gachagua and Kikuyus as they are not supporting him in good faith.
Ironically he has not yet religuished the Deputy Party Leader position he holds in Wiper Patriotic Front despite it being a legal requirement for appointees of government offices.
